Deux députés se sont penchés sur la question dans le cadre d’une mission parlementaire sur la consommation des stupéfiants en France.
Selon une information du quotidien Le Parisien en date du dimanche 21 janvier, les deux rapporteurs estiment qu’une amende forfaitaire serait plus efficace que le système actuel.
Dans le rapport, qui sera rendu au gouvernement mercredi, Eric Pouillat (LREM) et Robin Reda (LR) mettent en évidence les difficultés actuelles à mettre la loi en pratique concernant les fumeurs de cannabis.
Celle-ci prévoit une peine d’un an de prison ainsi qu’une amende dont le montant peut atteindre 3 750 euros.
Cependant, sur les 140 000 interpellations de l’année 2015, seulement 3 098 personnes ont été condamnées et 1 283 d’entre elles à une peine de prison ferme.
Dans l’essentiel des cas, un simple rappel à la loi ou un stage de prévention est proposé aux usagers de cannabis.
Selon Le Parisien, « la mise en place d’un dispositif d’amende forfaitaire –quelle que soit sa forme – est une réforme nécessaire ».
Ainsi, une amende d’un montant « raisonnable », fixée entre 150 et 200 euros, permettrait de financer des actions préventives.
Toutefois, les rapporteurs ne sont pas d’accord quant à la forme de cette amende.
Le député Eric Pouillat s’est dit en faveur d’une amende forfaitaire délictuelle, avec toujours la possibilité d’être renvoyé au tribunal, alors que Robin Reda préfère une contravention simple, sans garde à vue ni prison.
Ce travail autour d’un problème de santé public aussi important s’avère nécessaire, la France étant au premier rang européen en termes de consommation de cannabis.
Une réforme pénale sur la consommation de ce produit illicite et dangereux avait vu le jour en 2016 mais elle n’est toujours pas entrée en vigueur.
